Limitation of Liability.

Governing Law/Choice of Forum.

These Terms and any dispute arising out of or related to these Terms or your use of the Website shall be governed, construed, and enforced in accordance with the laws of the State of Wisconsin, without regard to conflicts of laws of any jurisdiction.

You agree that all controversies and claims brought by you or by Marcus that arise out of these Terms or your use of the Website shall be submitted for arbitration before the American Arbitration Association pursuant to the Commercial Dispute Resolution Procedures and the Supplemental Procedures for Consumer Related Disputes. The place of the arbitration shall be Milwaukee, Wisconsin. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

While your acceptance of this policy is voluntary, your continued use and/or participation in any of the foregoing constitute your acceptance of this policy and any other applicable terms.

How Marcus Collects and Uses Data.

You may generally use the Websites without disclosing personally identifiable information. However, use of certain services on the Websites may require you to submit personally identifiable information.

When you visit the Websites, Marcus automatically collects data on your usage of the Websites and your online behavior, e.g., previous websites you visited, your computer’s web browser, operating system, and IP address, and how you navigate and interact with the Websites. Marcus uses this information to accommodate your request and prepopulate data to streamline your future requests.

Marcus uses the information collected from you in a number of ways, including, without limitation, to improve the content and navigation of the Websites, to assist in the marketing and promotion of Marcus’s services in which you may be interested, to communicate with you for customer service purposes, and to prevent and detect fraud or other misuse of the Websites.
